Abstract This document is the typewritten original of document 6.02, which bears the handwritten title "Memorandum for trial brief and is located in Volume II of the Donovan Archive. Here, the document is referred to by the title given above. It evaluates the Notverordnung of 4 February 1933 and the Notverordnung of 28 February 1933 to argue that the Nazi state and its laws were unconstitutional on the terms set forth in the Weimer Constitution. This document is much more legible than its carbon copy. The paper is browning and fragile.
